Hang on, I think what you might be getting at got changed in The Road Traffic Act 1988.

The definition of a road in England and Wales is ‘any highway and any other road to which the public has access and includes bridges over which a road passes’.

In most cases, the law will apply to them and there may be additional rules for particular paths or ways. Agreed on public car parks as that is a place to which the public have access, however, a private car park is a different thing. The public's access is only by invitation & that access can be withdrawn at anytime. Effectively, it's the same as your driveway at home. therefore, no offence committed, bar the cannabis.

I think the legal definition is something to do with possible physical access rather than permission, so a locked gate would make it private.

But I'm going on dim-and-distant memories and Chinese Whispers from my days as a boy racer as these laws came into play.

My mate got a cannabis warning at Lime st station going up to manchester. He then applied for a voluntary position at a library whilst on the jam roll. Naff all came back on an enhanced disclosure - ie teacher/working with kids vulnerable people. Thing is you can only be officially cautioned by a sgt at the nick. Your aveeage pc on the st can't you have to be interviewed and admit guilt first.

The warning wont come out on a basic standard or enhanced disclosure as the human rights act gives you a right to a private life against whether it poses a threat to someone you could be working with.

Skinning up in a car park once does not make you a risk.

Best place to start is the force that warned you, their information department and find out what they hold on you.
